Diritto di Recesso
Right of Withdrawal
Fourteen days to change your mind, for any reason or for none. This page sets out the right as the law grants it, together with the statutory model form. You are not obliged to use the form, and you are not obliged to give us a reason.
Last updated 15 August 2026/Governed by Italian law
1. The right
Where you buy as a consumer, Articles 52 to 58 of the Italian Consumer Code (D.Lgs. 206/2005, implementing Directive 2011/83/EU) give you the right to withdraw from a distance contract within fourteen days, without giving any reason and without any penalty.
This is a legal right. It exists whether or not the product is faulty, and it is separate from the two-year legal guarantee of conformity, which covers faults. You can rely on either.
2. How long you have
The withdrawal period is 14 days from the day on which you, or a third party you have named other than the carrier, acquires physical possession of the goods.
- Several items in one order, delivered separately: the period runs from the day you receive the last item.
- An item delivered in several lots: the period runs from the day you receive the last lot.
- If the deadline falls on a Saturday, Sunday or public holiday, it extends to the next working day.
To meet the deadline it is enough that you send your statement before the period expires. The goods themselves may follow afterwards, within the period in section 5.
3. How to withdraw
Tell us, in an unambiguous statement, that you are withdrawing. Any of these is enough, and none is better than another:
- Email support@scmodaitalia.shop, in your own words
- Complete and send the model form in section 4, by email or by post
- Use the contact form, choosing “Returns, refunds or withdrawal”
- Write to us at Via XX Settembre 11/1, 80047 San Giuseppe Vesuviano (NA), Italia
- Call +39 335 847 1906 — we will confirm it in writing the same day so you have a record
Simply sending the goods back without telling us also works, but tell us as well: a parcel with no reference is hard to match to an order, and that delays your refund.
We will acknowledge receipt of your withdrawal without delay, on a durable medium.
4. Model withdrawal form
This is the statutory model form set out in Annex I, part B of the Consumer Code. Complete and return it only if you wish to withdraw. You do not have to use it.

5. What happens next
Send the goods back without undue delay and in any event within 14 days of the day you told us you were withdrawing. The deadline is met if you dispatch them before that period expires.
We reimburse all payments received from you, including the cost of the original delivery (with the exception described in section 6), without undue delay and in any event within 14 days of the day we are informed of your decision.
We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent them, whichever is the earlier. In practice we refund on the day the return is checked in.
We reimburse using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.
6. What it costs you
- Return postage. Where you are withdrawing because you changed your mind, you bear the direct cost of returning the goods. We estimate this at no more than the outbound shipping rate for your destination, shown on the shipping page.
- Outbound shipping. We refund what you paid for the original delivery, at the rate of our cheapest standard option. If you chose an express service, we refund the standard rate and not the premium you paid for speed.
- Faulty, damaged or wrong items. None of the above applies. We pay the return postage and refund the outbound shipping in full. See the legal guarantee.
7. Diminished value
You may handle and inspect the goods as you would in a shop: try the garment on, look at the inside face, check how it sits. Doing that costs you nothing and we will not reduce your refund for it.
You are liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. In practice that means washing it, wearing it outside, altering it, or returning it with damage, marks or odour it did not have on arrival.
If we do deduct for diminished value, we will tell you the amount and the reason in writing before issuing the refund, and you may dispute it through the routes in section 15 of the terms of sale.
8. Exceptions
Article 59 of the Consumer Code lists contracts to which the right of withdrawal does not apply. None of them applies to anything sold on this site. Our garments are made to a standard size range and are not made to your specification, not personalised, not perishable, not sealed for reasons of health or hygiene, and not inseparably mixed with anything after delivery.
We do not sell made-to-order or customised items through this store. Group and team enquiries made through the group order page are quotations, not purchases: no contract is concluded there, and if one is later agreed we will tell you in writing beforehand what withdrawal rights apply to it.
9. If we fail to inform you
If we had failed to give you this information before you were bound by the contract, the withdrawal period would have been extended by twelve months from the end of the initial fourteen-day period, in accordance with Article 53 of the Consumer Code.
We give it here, and it is linked from the product page, the bag, the checkout and the footer of every page, precisely so that the shorter period is the one that applies and you always know where to find it.
